Central General Terms and Conditions

1. Scope and Modification of CGTC

1.1These Central General Terms and Conditions (hereinafter: CGTC) have been unilaterally determined by Adventor Hotel Ltd. (Registered Office: 9740 Bükfürdő, Golf Road 4, company registration number: 18-09-114181, tax number: 27290431-2-18, hereinafter: Service Provider) for the purpose of concluding several contracts initiated from its central website for all hotels operated by it, hereinafter: Hotel), provided services by the Hotel or for the purpose of using them.

Hotels operated by Adventor Hotel Ltd:

The scope of these CGTC extends to the Service Provider, the persons concluding contracts for the provision of services with the Hotel (hereinafter: User or Guest), as well as to other third parties arriving with the Guests, and regulates essential elements of the legal relationship between these parties.

The scope of these CGTC does not extend to service providers, merchants, or agents who provide services provided by the Service Provider to third parties within any legal relationship or who act for this purpose.

The Guest accepts these CGTC by ordering the Service or using the Service.

1.2. These CGTC must be applied in the legal relationships falling within their scope, with the understanding that the Guest acts in accordance with the currently valid General Terms and Conditions (hereinafter GTC) of the selected Hotel and accepts them when ordering the service.

1.3. Before applying the provisions of these CGTC or in case of their modification, the Service Provider shall take all necessary steps to ensure that the persons falling within their scope become acquainted with their content as soon as possible and accept them. The Service Provider shall inform the other party separately about any general contractual condition that substantially differs from legal regulations or customary contractual practices.

1.4. The Service Provider informs the Guest that the currently valid version of these CGTC can be accessed at the following locations: online: www.adventorhotels.hu/general-terms-and-conditions.

1.5. These CGTC shall remain in effect from April 24, 2024, until revoked by the Service Provider or unilaterally modified by it.

1.6. The Service Provider is entitled to unilaterally modify the CGTC at any time. The modification cannot override the itemized provisions of any individual contract. The Service Provider shall publish the modification on its website at least 8 days before the planned changes take effect and shall also send a separate written (email) notification to those Guests whose booking was made before the modification takes effect, however, the service (even partially) is provided after the modification takes effect. If the modification of the CGTC is significantly disadvantageous for the Guest, they have the right to terminate the reservation within 4 days from the sending of the notification. If the Guest does not declare within 4 days after the notification has been sent or continues to use the services without reservation, the modification of the CGTC shall be deemed accepted by them.

2. Service

2.1. The services provided by a Hotel operated by the Service Provider can be ordered, reserved, or used in accordance with the GTC of the respective Hotel. The Guest accepts that during the reservation, the GTC of the selected Hotel also becomes part of the contract. The Guest accepts that during the reservation process, after selecting the Hotel, the reservation process continues according to the conditions of the respective Hotel.

3. Security of Data Processing

3.1. Providing the name and email address is mandatory to subscribe to the newsletter on the Service Provider's website. By subscribing to the Newsletter, the User consents to the processing of the provided data. The Service Provider processes the data until the data subject requests deletion.

3.2. The option to unsubscribe is provided in every newsletter via a direct link, and it is also possible on the website at the following contact points: …………………………………………………

3.3. The User is responsible for the authenticity of the provided personal data.

3.4. The Service Provider protects the data, especially against unauthorized access, alteration, transmission, disclosure, deletion, or destruction, as well as accidental destruction and damage.

3.5. The Service Provider, together with the server operators, ensures the security of the data.

3.6. Only the employees of the data controller have access to the personal data provided by the User. The data controller does not transfer personal data to third parties other than those designated.

3.7. For more information on the processing of personal data, please refer to the "Data Protection Information" available on the website (www.adventorhotels.hi/privacy-policy) or request information at info@adventorhotels.hu. The Guest declares their acknowledgment and acceptance of the information contained in the Data Protection Information when initiating the reservation.

3.8. The Guest acknowledges that the Service Provider is obliged to provide personal data to the requesting authority based on legal authorization if the legal conditions are met. The Guest cannot object to data provision based on legal, authority, or court decisions.

3.9. In fulfilling the obligations stipulated in the Contract, the Service Provider is obliged to act in accordance with the legal provisions regarding the processing of personal data.

4. Data of Visitors to the Service Provider's Website.

4.1. When visiting the website operated by the Service Provider, neither the user's IP address nor any other personal data is recorded. Searching is freely and anonymously provided during the visit to the website. The Service Provider uses anonymous internet visits solely for statistical purposes, to optimize its internet presence, and to increase system security; the recorded data does not contain any personal information.

4.2. The Service Provider treats all data and facts related to Users confidentially and uses them exclusively for its own research and statistics.

4.3. The Service Provider does not assume responsibility for deleted but archived previous pages that are still accessible through search engines. It is the responsibility of the operator of the search page to remove them.

1. KÁSZF hatálya, módosítása

1.1. A jelen Központi Általános Szerződési Feltételeket (a továbbiakban: KÁSZF) az Adventor Hotel Kft. (Székhely: 9740 Bükfürdő, Golf út 4., cégjegyzékszáma: 18-09-114181, adószáma: 27290431-2-18, a továbbiakban: Szolgáltató) a központi honlapjáról indított több szerződés megkötése céljából egyoldalúan határozott meg az általa üzemeltetett valamennyi szálloda, a továbbiakban: Szálloda) által nyújtott szolgáltatások nyújtása, illetőleg azok igénybevétele céljából.

Adventor Hotel Kft. által működtetett Szállodák:

Jelen KÁSZF hatálya kiterjed a Szolgáltatóra, a Szállodával a szolgáltatások igénybevételére szerződést kötő személyekre (a továbbiakban: Felhasználó vagy Vendég), valamint a Vendégekkel együtt érkező más, harmadik személyekre is, és szabályozza ezen felek közötti jogviszonyra vonatkozó lényeges elemeket.

Jelen KÁSZF hatálya nem terjed ki azon szolgáltatókra, kereskedőkre vagy ügynökökre, akik a Szolgáltató által nyújtott szolgáltatásokat bármilyen jogviszony keretében nyújtják harmadik személyek részére vagy azokra, akik ennek érdekében járnak el.

A jelen KÁSZF-et a Vendég a Szolgáltatás megrendelésével vagy a Szolgáltatás igénybevételével elfogadja.

1.2. A jelen KÁSZF-et kell alkalmazni a hatálya alá tartozó jogviszonyokban, azzal, hogy a Vendég az általa kiválasztott Szálloda mindenkor hatályos Általános Szerződési Feltételei (a továbbiakban ÁSZF) szerint és annak elfogadásával jár el a szolgáltatás megrendelése során.

1.3. A Szolgáltató a jelen KÁSZF rendelkezéseinek alkalmazása előtt, illetőleg azok módosulása esetén mindent megtesz annak érdekében, hogy az azok hatálya alá tartozó személyek ezek tartalmát mielőbb megismerjék, illetőleg azokat elfogadják. A Szolgáltató külön tájékoztatja a másik felet arról az az általános szerződési feltételről, amely lényegesen eltér a jogszabályoktól vagy a szokásos szerződési gyakorlattól.

1.4. Szolgáltató tájékoztatja Vendéget, hogy a jelen KÁSZF hatályos változata az alábbi helyeken érhető el: interneten: www.adventorhotels.hu/altalanos-szerzodesi-feltetelek

1.5. Jelen KÁSZF 2024. április 24. napjától visszavonásig, vagy annak Szolgáltató általi egyoldalú módosításáig hatályos.

1.6 Szolgáltató a KÁSZF-et bármikor jogosult egyoldalúan módosítani. A módosítás az esetleges egyedi szerződés tételes rendelkezéseit nem írhatja felül. A módosítást Szolgáltató a tervezett változások hatályba lépését megelőzően legalább 8 nappal korábban a honlapján közzéteszi és azoknak a Vendégeknek, akik foglalása még a módosítás hatályba lépése előtt történt, a szolgáltatás azonban (akár csak részben) a módosítás hatályba lépését követően teljesül, külön írásos (e-mailes) értesítést is küld erről (a Vendégnek közvetlenül vagy közvetve a Vendég érdekében foglaló harmadik személyen keresztül).

Amennyiben a Vendég számára a KÁSZF módosítása lényegesen előnytelenebb, mint a módosítás előtti KÁSZF, jogában áll a foglalást az értesítés megküldésétől számított 4 napon belül felmondani. Amennyiben a Vendég az értesítés megküldését követően 4 napon belül nem nyilatkozik vagy ráutaló magatartással továbbra is fenntartások nélkül igénybe veszi a szolgáltatásokat, úgy a KÁSZF módosítás a részéről elfogadottnak tekintendő.

2. Szolgáltatás

2.1. A Szolgáltató által működtetett valamely Szálloda szolgáltatásait az adott Szálloda ÁSZF-je szerint lehet megrendelni, lefoglalni illetve igénybe venni. Vendég elfogadja, hogy a foglalás során az általa kiválasztott Szálloda ÁSZF-je is a szerződés részévé válik. Vendég elfogadja, hogy a foglalás során a foglalási folyamat az általa kiválasztott Szálloda megjelölése után az adott Szálloda feltételeinek megfelelően folytatódik. 

2.2. A Szolgáltató által működtetett Szállodák ÁSZF-jeinek hatályos szövege az alábbi linkeken érhetők el.

3. Az adatkezelés biztonsága

3.1. A Szolgáltató honlapján lévő hírlevélre való feliratkozáshoz a név és e-mail cím megadása kötelező. A Hírlevélre történő feliratkozással a Felhasználó hozzájárul megadott adatai kezeléséhez. A Szolgáltató az adatokat mindaddig kezeli, ameddig azok törlését az érintett nem kéri.

3.2. A leiratkozás lehetőségét minden hírlevélben egy közvetlen link biztosítja, illetve a weboldalon is van rá lehetőség az alábbi elérhetőségeken: ………………………………………………..

3.3. A megadott személyes adatok valódiságáért a Felhasználó felel.

3.4. A Szolgáltató az adatokat védi különösen a jogosulatlan hozzáférés, megváltoztatás, továbbítás, nyilvánosságra hozatal, törlés vagy megsemmisítés, valamint a véletlen megsemmisülés és sérülés ellen.

3.5. A Szolgáltató a szerver üzemeltetőivel együtt gondoskodik az adatok biztonságáról.

3.6. A Felhasználó által megadott személyes adatokhoz kizárólag az adatkezelő munkatársai férhetnek hozzá. Személyes adatokat a megjelölteken kívül harmadik személyeknek az adatkezelő nem ad át.

3.7. A személyes adatok kezeléséről bővebb tájékoztatást talál a honlapon elérhető "Adatkezelési Tájékoztató" – ban (www.adventorhotels.hi/adatvedelmi-tajekoztato) vagy tájékoztatást kérhet az info@adventorhotels.hu címen. Vendég az Adatkezelési tájékoztatóban foglaltakat megismeréséről és elfogadásáról a foglalás kezdeményezésekor nyilatkozik.

3.8. A Vendég tudomásul veszi, hogy a Szolgáltató törvényi felhatalmazás alapján köteles a megkereső hatóság részére személyes adatot kiadni, amennyiben annak törvényi feltételei fennállnak. A törvényen, hatósági vagy bírósági határozaton alapuló adatszolgáltatással szemben a Vendég nem emelhet kifogást.

3.9 A Szolgáltató a Szerződésben foglalt kötelezettsége teljesítése során köteles a személyes adatok kezelésére vonatkozó jogszabályi rendelkezések szabályainak megfelelően eljárni.

4. A Szolgáltató weboldal látogatóinak adatai

4.1. A Szolgáltató az általa üzemeltetett weboldal látogatásakor sem a felhasználó IP címét, sem más személyes adatot nem rögzít. A weboldal látogatása során szabadon és név nélkül biztosított a keresés. A Szolgáltató a név nélküli internetes látogatást kizárólag statisztikai célokra használja fel, internetes megjelenése optimalizálására, a rendszer biztonságának növelésére, a rögzített adatok nem tartalmaznak semminemű személyes adatot.

4.2. A Szolgáltató a Felhasználókra vonatkozó valamennyi adatot és tényt bizalmasan kezel, azokat kizárólag saját kutatás, statisztika készítéséhez használja fel.

4.3. A Szolgáltató nem vállalja a felelősséget a már törölt, de az internetes keresőprogramok közreműködésével mégis archiválásra került, korábbi oldalaiért. Ezek eltávolításáról a keresőoldal működtetőjének kell gondoskodni.
